
Breast Cancer Care has contacted Ashcroft-backed Tory Caroline Nokes to say they will not accept any charitable donations from her after using their logo and branding for a Conservative Party leaflet.
It also emerges that Nokes herself would be in breach of Charity Law if she had put out her leaflet in the new year as it is expected that promises of donations of unspecified amounts are to be made illegal in the new year under the Charities Act.

In the parts of the leaflet that you are highlighting it appears to me that Caroline Nokes is not ’soliciting money or other propery’ for the charity - she is merely asking people to complete a survey and saying that she will make a personal donation to charity for each form received. As such it does not appear to me that she is in breach of the law (new section 60A of the Charities Act 1992 - I am not certain at the moment whether it came into force in Feb 07 or will come into force in Apr 08 or is yet to be the subject of an Order - as is often the case, the Orders in Council need to be looked at in detail and I have not looked at them in sufficient detail to consider the dates on which the law comes into force).

YOU ARE CORRECT NOKES REALISED SHE COULD GET AWAY WITH NOT BREACHING THE CHARITYS ACT THAT IS WHY SHE SENT OUT THE LEAFLET IN DECEMBER 07.NO THOUGHT OF WHAT THE DAMAGE TO THE CHARITY THIS WOULD DO. SHE IS A RUTHLESS TORY BITCH.

If you believe that there would be a breach of a section of the Charities Act, would you please let me know which one you think was breached? I have looked through it again and can find none that would be breached by what was done …
